Defendant Solano County Courthouse’s demurrer to plaintiff’s First Amended
Complaint (“1AC”) is SUSTAINED without leave to amend, as follows.
The 1AC purports to assert four (4) causes of action against the sole named
defendant, the Solano County Courthouse: Defamation, stalking, harassment and
extortion. In reality, the substance of the allegations relate to the conduct of two judges in Solano County who apparently issued various rulings adverse to plaintiff.
Defendant now demurs to the entire 1AC on the grounds it fails to plead compliance
with the Government Claims Act and it is barred by judicial immunity.
Although plaintiff filed an opposition, it fails to meaningfully respond to the legal
arguments asserted in defendant’s demurrer and fails to demonstrate that either of the
grounds for the demurrer is without merit. Accordingly, the demurrer is sustained.
Because plaintiff has now had two opportunities to plead her causes of action,
because plaintiff has failed to demonstrate how the deficiencies noted above may be
cured and because this Court concludes plaintiff does not have a reasonable
probability of curing the defects noted above, leave to amend is denied.
Finally, the Court notes that plaintiff Barnes was declared to be a vexatious litigant
pursuant to a minute order issued on 7/18/2013 in Sacramento Superior Court Case
No. 34-2012-00130337, Barnes vs. American River College.
This minute order is effective immediately. Pursuant to CRC Rule 3.1312, defendant
to prepare a formal order and proposed judgment of dismissal.
