Defendant/X-Defendant Global Security Concepts, Inc.’s (“GSC”) (1) Motion to Compel Plaintiff Jane Doe 1 to Provide Further Responses to Form Interrogatories (Set One) and Request for Monetary Sanctions and (2) Motion to Compel Plaintiff Jane Doe 2 to Provide Further Responses to Form Interrogatories (Set One) are GRANTED. The request for sanctions in the amount of $2650/motion is granted. Further responses to be served within 10 days.
ANALYSIS: Defendant GSC propounded form interrogatories (set one) on Plaintiffs Jane Doe 1 on Jane Doe 2 on 6/22/16. Plaintiffs Jane Doe 1 served responses in September 2016 and then served verified supplemental responses on 1/6/17. Parties continued to meet and confer on the sufficiency of the supplemental responses, but Plaintiffs’ counsel has not yet provided any supplemental responses. Parties agreed to extend the time to bring this motion to compel further responses. Defendant GSC acknowledges that Plaintiffs’ counsel has suffered a traumatic injury that interfered with his ability to respond. However, Defendant GSC has waited for supplemental responses for more than a year and an order compelling further responses is necessary.
In response, Plaintiffs’ counsel failed to file any opposition to these motions to compel further responses. However, Plaintiffs filed an opposition to the motion to compel further responses from Jane Doe 1 to special interrogatories acknowledging that Jane Doe 1 and 2’s discovery responses to all disputed discovery were insufficient. Plaintiffs’ counsel indicated the failure to serve supplemental responses was due to his traumatic injury, which he has been treated. Plaintiffs’ counsel indicated that supplemental responses will be served to all discovery propounded on both Jane DOE 1 and Jane DOE 2 prior to the 1/10/18 hearing date. Supplemental responses were not served with the opposition.
In light of Plaintiffs’ admission that supplemental responses are required, the motions to compel further responses to form interrogatories from Plaintiff Jane Doe 1 and Jane Doe 2 are GRANTED. Defendant GSC’s request for sanctions in the amount of $2,650 (12 hours of work)/motion is reasonable. Plaintiffs and her counsel are ordered to pay the sanctions within 10 days. Plaintiffs Jane Doe 1 and 2 are ordered to serve further responses to the form interrogatories at issue within 10 days.
