Defendant propounded RFAs on Plaintiff on 11/08/17. To date, despite an attempt to meet and confer, Plaintiff has not served responses. Defendant therefore seeks an order deeming the RFAs admitted and requiring Plaintiff to pay sanctions.

Defendant’s motion is granted. The RFAs are deemed admitted. CCP §2033.280(a), (b).

Sanctions are mandatory. §2033.280(c). Defendant seeks sanctions in the amount of $420 – two hours to prepare the motion and one hour to appear at the hearing, all at $120/hour, plus filing fees. The Court awards one hour to prepare the form discovery motion. The Court finds reasonable and awards the requested one hour to appear at the hearing. The Court therefore awards a total of two hours of attorney time at the requested rate of $120/hour, or $240 in attorneys’ fees. The Court also awards the filing fees of $60. Sanctions are sought and imposed against Plaintiff, in pro per; she is ordered to pay sanctions to Defendant, by and through his attorney of record, in the total amount of $300, within twenty days.
