REQUEST FOR ORDER FOR MODIFICATION OF CHILD CUSTODY, VISITATION

TENTATIVE RULING

The Court has read and considered the pleadings, declarations, and other evidence submitted in this matter. After full consideration of these matters, and for good cause shown, the Court makes the following findings and orders:

1. Petitioner/Father’s request for joint legal and physical custody of the minor child as well as

unsupervised visits every other weekend is DENIED. The Court acknowledges Mr. Vesper’s participation in AA meetings and encourages him to continue his recovery and treatment, including meeting with his sponsor. Mr. Vesper has had two supervised visits with his daughter. However, after considering the child’s disability and special needs, the history of child neglect by the father, the father’s history of alcohol abuse, and the lack of prior consistent supervised visitation, the Court does not find Petitioner/Father’s requested custody orders to be in the best interest of the child. Therefore, the Court maintains the previous order for temporary sole legal and physical custody of the minor child to the Respondent Mother.

2. Petitioner/Father shall continue to have supervised visits at Rally for up to three visits per week, up to 2 hours per visit, subject to Rally’s availability. Each party shall pay for their own intake fees. Petitioner/Father shall pay 100% of all additional costs for supervised visitation.

3. The matter is continued for review hearing on Father’s visits on September 11, 2018, at 9:00 a.m. in this Department.
