Defendant in pro per Raj Singh’s “Motion to Set Aside Defaults and For Other Relief” is on the court’s own motion continued to 4/11/2018 at 9:00 a.m. in this department, as follows.

This is defendant’s fifth time filing what he has designated as a motion to set aside default in this action. The court notes that none of these five motions nor another motion to reconsider the ruling on a prior motion to set aside, has been opposed by plaintiff who is represented by counsel and who recently obtained a $4.7 Million-plus default judgment against the moving defendant.

Consequently, although defendant filed a proof of service indicating plaintiff’s counsel was served with the moving papers, this court is not satisfied that actual service of the moving papers occurred here.

The clerk is directed to mail a copy of this minute order to plaintiff’s counsel of record so that s/he may file and serve an opposition to the present motion no later than 3/23/2018.

Defendant may file and serve his reply, if any, no later than 4/2/2018.
