Motion to compel depositions

TENTATIVE RULING:

The Motion of Plaintiff Jane Doe #2 (“Plaintiff”) to Compel Deposition Testimony and Documents from County of San Mateo Human Resources Department and for Sanctions, is ruled on as follows:

Plaintiff’s Motion to Compel Deposition Testimony and Documents is GRANTED. (See Code of Civ. Proc. sec. 2025.480(a).) Although he is a party to this action, Defendant Manuel Sedillo-Messer (“Messer”) served an objection rather than bringing a motion to quash or modify the deposition subpoena for his employment records under Code of Civil Procedure section 1985.6. The court has still considered his privacy objection though, absent any authority that the court must disregard it. Nevertheless, Plaintiff establishes that her need for this information outweighs any privacy right asserted by Messer in his employment records.

The County of San Mateo Human Resources Department is to produce the person most qualified for deposition on all eight topics and produce all subpoenaed documents as identified in Plaintiff’s November 17, 2017 subpoena. The deposition is to take place within 20 days following the date of the order.

Plaintiff’s request for monetary sanctions is DENIED.
