Case Number: BC6444678 Hearing Date: March 16, 2018 Dept: 32

Joseph Smith,

Plaintiff,

v.

AMR Staffing, Inc., et al.

Defendants.

Case No.: BC644678

Hearing Date: March 16, 2018

[TENTATIVE] order RE:

(1) Motion to compel further responses and documents to plaintiff’s first set of requests for production of documents, set one

(2) Motion to compel further responses to plaintiff’s first set of form interrogatories (general), set one

(3) Motion to compel further responses to plaintiff’s first set of form interrogatories (employment), set one

(4) Motion to compel further responses to plaintiff’s first set of special interrogatories, set one

Plaintiff Joseph Smith (“Plaintiff”) moves to compel Defendant AMR Staffing, Inc. (“Defendant”) to provide further responses to requests for production of documents, form interrogatories (general and employment), and special interrogatories. As set forth in the motions, Defendant’s response to the above discovery was comprised solely of objections. Defendant does not oppose the motions to justify its objections. Accordingly, the motions are GRANTED.

Plaintiff requests monetary sanctions for each motion. However, the sanctions calculation includes time anticipated for drafting a reply. (See Nava Decl.) Given that no opposition was filed, the Court reduces the sanctions award accordingly. The Court credits Plaintiff’s counsel with 5.3 hours spent on the four motions plus 2 hours anticipated to attend the hearing at a rate of $405 per hour, plus an additional $240 for filing fees. Accordingly, the Court GRANTS Plaintiff’s sanctions request in the reduced amount of $3,196.50.
