[TENTATIVE] ORDER GRANTING DEFENDANTS’ UNOPPOSED MOTIONS TO COMPEL

Defendants, Jaqueline and Shalom Belillti propounded special interrogatories, set three, supplemental interrogatories, and supplemental RPDs on Plaintiff, Juan Carlos Hernandez on 3/23/18. To date, Plaintiff has not served responses. Defendants therefore seek an order compelling Plaintiff to respond, without objections, to the outstanding discovery and to pay sanctions.

Defendants’ motions are granted. Plaintiff is ordered to serve verified responses to special interrogatories, set three, supplemental interrogatories, and supplemental RPDs, without objections, within ten days. CCP §§2030.290(a),(b), 2031.300(a),(b).

Sanctions are mandatory. §§2030.290(c), 2031.300(c). Defendants seek sanctions in the amount of $532.50/motion. Counsel’s declarations in support of the motions are confusing. At ¶7 of each declaration, Counsel declares he spent one hour preparing the moving papers. At ¶8, he declares he spent 1.7 hours preparing the moving papers. The Court finds one hour to prepare each form motion to compel is reasonable. No opposition was filed and therefore no time to file a reply is awarded. Counsel does not seek to recover time for appearance at the hearing on the motions. The Court therefore awards three hours of attorney time at the requested rate of $175/hour, or $525 in attorneys’ fees. The Court also awards three filing fees, or $180 in costs.

Plaintiff and his attorneys of record, jointly and severally, are ordered to pay sanctions to Defendants, by and through their attorney of record, in the amount of $705, within twenty days.

Defendants are ordered to give notice.
