Plaintiff’s attorney of record, Logan Quirk, seeks to be relieved as counsel, contending Plaintiff is not responding to attempts at communication such that further representation is impossible. The motion is denied without prejudice for the following reasons:

Counsel declares, at ¶3(a)(2) and 3(b)(1)(a) and (b), that he has served the moving papers on Plaintiff via mail at an address confirmed by certified mail and telephone. If Counsel has a return receipt, signed by Plaintiff, Counsel must bring it to the hearing. To the extent Counsel is saying the address was confirmed by telephone, this is directly contradicted by his statement, at ¶2, that he has been trying to call Plaintiff since March and Plaintiff has not answered or responded.

The Court cannot locate a proposed order on the motion, as required by CRC 3.1362(d) and (3);

Counsel filed proof of service of the motion and a proposed order, but not of the declaration in support of the motion.

Counsel is ordered to give notice.
