Plaintiff’s motion to deem requests for admissions admitted is denied.

Self-represented Defendant Latasha Mitchell served before the “hearing on the motion” proposed responses that are in substantial compliance with CCP § 2033.220. (CCP § 2033.280(c).) As a result, the motion for order deeming matters admitted must be denied.

No sanctions were requested and none are awarded.

While not relevant to the resolution of the motion, Defendant’s opposition incorrectly argues that Plaintiff failed to meet and confer. There is no meet and confer requirement for a motion to deem requests for admissions admitted where, as here, a party failed to timely serve responses to requests for admissions. (CCP § 2033.280.)
