Defendant, Mahmood Daemi’s Motion to Compel Plaintiff’s responses to Demand for Production of Documents, set two is granted. Plaintiff to respond without objection within 10 days. Sanctions of $828.50 are imposed against Plaintiff and counsel.

Facts
Plaintiff, Mahsa Moayyed Mohseni filed this action against Defendant, Mahmood Daemi for damages arising out of an automobile accident.

Motion to Compel Responses
Defendant propounded Requests for Production of Documents, set two upon Plaintiff on 5/15/13, and responses were due no later than 6/19/13. On 1/10/14, Defense counsel sent Plaintiff a letter requesting responses. Exhibit C. Plaintiff and counsel ignored the request and failed to respond or provide responses. To date no responses have been received in contravention of CCP §2031.210.
Plaintiff fails to oppose this motion. Therefore, Plaintiff’s responses should be compelled pursuant to CCP §2031.300.
Defendant seeks sanctions of $828.50 against Plaintiff and counsel for the 5.3 hours at $145.00 an hour for time spent preparing this motion, filing fees, and attending the hearing. The Court finds that sanctions are appropriate based on Plaintiff’s willful failure to abide with discovery obligations. CCP § 2031.330(c), The request for sanctions is therefore granted.
