[TENTATIVE] ORDER GRANTING DEFENDANTS’ UNOPPOSED MOTION TO DEEM RFAS ADMITTED

Defendants propounded RFAs on Plaintiff on 6/26/19. To date, Plaintiff has not served responses. Defendant therefore seeks an order deeming the RFAs admitted and imposing sanctions.

Defendants’ motion to deem RFAs admitted is granted. CCP §2033.280(b). Sanctions are mandatory. §2033.280(c). Defendants seek sanctions in the amount of $1460. Defense Counsel bills at the rate of $200/hour. The Court awards one hour to prepare the form discovery motion. No opposition was filed and therefore no reply was necessary. The Court awards the requested three hours of time to appear, as Counsel is located in Woodland Hills. The Court therefore awards a total of four hours of attorney time at the requested rate of $200/hour, or $800 in attorneys’ fees. The Court also awards the requested $60 in costs.

Sanctions are sought and imposed against Plaintiff and her attorney of record, jointly and severally; they are ordered to pay sanctions to Defendants, by and through their attorney of record, in the total amount of $860, within twenty days.

Defendants are ordered to give notice.
