CROSS—DEFENDANTS MATTHEW SQUIRES AND NICOLE SQUIRES’ MOTION FOR TERMINATING SANCTIONS AGAINST CROSS—COMPLAINANT ROBERT C. WEHMEYER (OR ISSUE SANCTIONS IN THE ALTERNATIVE) AND MONETARY SANCTIONS TENTATIVE RULING:

Plaintiffs Matthew and Nicole Squires’ Motion for Terminating Sanctions and/or Issue and Monetary Sanctions, filed 1-24-19, is GRANTED-IN-PART and DENIED-IN-PART. Code Civ. Proc. § 2023.030.

The request for terminating and issue sanctions is DENIED.

Plaintiffs’ request for monetary sanctions is GRANTED in the amount of $4,000, which Defendant Robert Wehmeyer shall pay to Plaintiffs within 15 days of this Order.

Defendant Robert Wehmeyer’s Opposition papers purport to attach verified, complete responses to Special Interrogatories Nos. 19, 26, 29 and 30, but they have not been provided to the Court, or apparently to Plaintiffs. By 5 p.m. on the date of the hearing (34-19), Robert Wehmeyer shall personally serve on Plaintiffs’ counsel verified, complete, non-evasive responses to Special Interrogatories Nos. 19, 26, 29 and 30, without objections.

Plaintiffs’ 2-25-19 Objections to the 2-19-19 Newcomb declaration are OVERRULED.

If the tentative ruling is uncontested, it shall become the order of the Court. Thereafter, counsel for Plaintiffs shall prepare a written order consistent with the Court’s ruling for the Court’s signature, pursuant to California Rules of Court, Rule 3.1312, and provide written notice of the ruling to all parties who have appeared in the action, as required by law and the California Rules of Court.
