MICHAEL BOSTIC VS. MT. OLIVE APOSTOLIC ORIGINAL HOLY CHURCH OF GOD

18-CIV-04269

MICHAEL BOSTIC, ET AL. VS. MT. OLIVE APOSTOLIC ORIGINAL HOLY CHURCH OF GOD, ET AL.

MICHAEL BOSTIC MT. OLIVE APOSTOLIC ORIGINAL HOLY CHURCH OF GOD
DENISE EATON-MAY FRANK E. MAYO

MOTION TO COMPEL FURTHER RESPONSES TO THEIR FIRST SETS OF FORM INTERROGATORIES, SPECIAL INTERROGATORIES AND REQUESTS FOR PRODUCTION TO DEFENDANTS AND FOR MONETARY SANCTIONS BY MICHAEL BOSTIC, SHAMEALLE BOSTIC AND MICHELLE NORRIS TENTATIVE RULING:

Plaintiffs’ Motion to Compel Further Responses to Form Interrogatories, Special Interrogatories and Requests for Production of Documents is GRANTED. Defendants shall provide further responses within 10 days of this Order. Defendants rely exclusively on Plaintiffs’ failure to file separate statements supporting the motion as grounds for denial. Because Defendants have submitted no substantive opposition to the motion, however, the Court concludes the motion should be granted. Further, in stating that they “will file amended responses to this motion prior to March 18th,” Defendants have essentially conceded that further responses are necessary.

The Request for Sanctions is GRANTED in the amount of $1,600.00.

If the tentative ruling is uncontested, it shall become the order of the Court. Thereafter, counsel for Plaintiffs shall prepare a written order consistent with the Court’s ruling for the Court’s signature, pursuant to California Rules of Court, Rule 3.1312, and provide written notice of the ruling to all parties who have appeared in the action, as required by law and the California Rules of Court.
