The motion of Defendant / Cross-Complainant / Cross-Defendant Realty Roundup, Inc. (RRI) for an order compelling responses to its first sets of form interrogatories, special interrogatories and document requests is UNOPPOSED and GRANTED.
RRI served the discovery on 6/13/18, Plaintiff Michael Scallin only responded with untimely, unverified responses, which are tantamount to no responses at all.
No later than 10/05/18, Scallin shall serve verified written responses, without objections, to the first sets of form interrogatories, special interrogatories and document requests. The responses shall strictly comply with CCP §§ 2030.210,
2030.220 and 2030.250; or with 2031.210-2031.250, except that no objections may be raised.
Because the motion is unopposed, no monetary sanction is imposed in relation to the first sets of form interrogatories, special interrogatories and document requests.
RRI’s further motion for an order deeming admitted its first set of requests for admissions propounded to Scallin is UNOPPOSED and GRANTED.
Pursuant to CCP § 2033.280(c), the court imposes a mandatory monetary sanction in the amount of $360 (1 hr @ reasonable rate of $300/hr + $60 filing fee). Scallin and his counsel, Lauro Feliciano, shall pay the sanction no later than October 22, 2018. If Scallin and Feliciano fail to pay the sanction by such date, then RRI may lodge for the court’s signature a formal order awarding sanctions, which may be enforced as a
separate judgment. (See Newland v. Superior Court (1995) 40 Cal.App.4th 608, 615.)
The minute order is effective immediately. No formal order pursuant to CRC 3.1312 or further notice is required.
