TENTATIVE RULING

Notice of Automatic Stay pursuant to 11 USCA 362(a) was filed in this matter on 12/27/2017 as to Iron City Armory, LLC. The matter was stayed. As part of the default package Plaintiff is now dismissing Iron City Armory, LLC, so the stay is lifted and the court proceeds to consider the default package as to the loan guarantor, Jason Doetzer.

The default package complies with CRC 3.1800.

The court has considered the Complaint and the exhibits to the Complaint and that the statements pleaded therein are deemed admitted by the default.

Additionally, the court has considered the declarations and exhibits from Sandra Otero.

Based upon the evidence presented, judgment in favor of Plaintiff and against Defendant Jason Doetzer is proper in the principal sum of $31,381.05. Plaintiff is entitled to prejudgment interest on the principal in the sum of $1,159.65.

Further Plaintiff is entitled under Paragraph 14 of the Business Loan agreement to an award of reasonable attorney’s fees which the court finds is $1,331.43.

Costs of suit are awarded in the sum of $635.

Plaintiff’s proposed judgment is approved as to form and is signed by the court. The clerk is directed to enter judgment.
