TENTATIVE

Petitioner’s Two (2) Motions to Compel Responses to Special Interrogatories, Set Two, and Demand for Production of Documents, Set Two; Request for Sanctions is GRANTED. Respondent, Adam Fish, is ordered to provide verified responses without objections to the foregoing discovery within 14 days. Cal Code Civil Procedure § 2030.290(b), 2031.300(b).

Respondent’s failure to respond results in a waiver of objections. Cal Code Civil Procedure § 2030.290(a), 2031.300(a).

The court has jurisdiction to compel responses in this action. Ins Code § 11580.2.

Imposition of sanctions are permitted in favor of a party who files a motion to compel discovery, even though no opposition to the motion was filed or the requested discovery was provided to the moving party after the motion was filed. Cal Rules of Court 3.1348(a).

The court imposes total sanctions of $815.00 for both motions against Respondent, Adam Fish, and his counsel, James Vititoe, for the failure to respond or submit to an authorized method of discovery, which is discovery abuse. Cal Code Civil Procedure §2023.010(d).

Moving party is ordered to give notice.
