Plaintiff’s MOTION TO CONTINUE TRIAL
Plaintiff Norma Hernandez (“Plaintiff”) seeks to continue the final status conference and trial. Currently, the FSC is set for March 28, 2018, and trial is set for April 9, 2018. Plaintiff seeks to continue these matters to allow for possible follow up surgeries and to pursue mediation. Plaintiff states that she underwent surgery on her back in May of 2017 and may need further surgery. Plaintiff’s surgeon will be determining whether to pursue additional surgery in April of 2018, after additional time and testing. Th parties have also agreed to pursue private mediation. This mediation, however, cannot take place until after Plaintiff’s follow up appointment with her surgeon.
Plaintiff provides as Exhibit 1 a stipulation between both parties agreeing to the continuance, but the second page of the stipulation, which presumably bears the parties’ signatures, is missing from the scanned, electronic version of the exhibit. Regardless, Defendant was served with the motion and has not filed any opposition.
Plaintiff’s request to continue these matters is granted based upon good cause shown. Trial is continued to December 4, 2018, at 8:30 a.m. in this department. The final status conference is continued to November 20, 2018, at 10:00 a.m. in this department. All discovery, motion, and expert cut-off dates will be tied to the new trial date.
Plaintiff is ordered to provide notice of this order.
