[TENTATIVE] ORDER GRANTING DEFENDANT’S UNOPPOSED MOTIONS TO COMPEL

Defendant propounded special interrogatories, set two and RPDs, set two on Plaintiff on 517/18. To date, despite an attempt to meet and confer, Plaintiff has not served responses. Defendant seeks an order compelling Plaintiff to respond, without objections, to the discovery and to pay sanctions.

As an initial note, Defendant erroneously reserved these motions as motions to compel further responses and set them for hearing at 10:00 a.m. These are motions to compel initial responses, which the Court hears at 1:30 p.m. The Court will hear argument on these motions, if any, at 1:30 p.m. on 8/31/18.

Defendant’s motions are granted. Plaintiff is ordered to serve verified responses to the outstanding discovery, without objections, within ten days. CCP §§2030.290(a),(b), 2031.300(a),(b).

Sanctions are mandatory. §§2030.290(c), 2031.300(c). Defendant seeks sanctions in the amount of $1260/motion – two hours to meet and confer and prepare each motion and two hours to draft a reply and appear at the hearing, all at $300/hour, plus filing fees. The Court awards .5 hours to meet and confer, one hour to draft each motion, and one hour to appear; no opposition was filed, and therefore no reply was necessary. The Court awards a total of 3.5 hours of attorney time at the requested rate of $300/hour, or $1050. The Court also awards two filing fees of $60 each.

Sanctions are sought and imposed against Plaintiff and her attorney of record, jointly and severally; they are ordered to pay sanctions to Defendant, by and through its attorney of record, in the total amount of $1170, within twenty days.

Defendant is ordered to give notice.
