Judgment creditor’s notice of hearing does not provide notice of the court’s tentative ruling system, as required by Local Rule 1.06, and does not provide the correct address for Department 53/54. Judgment creditor’s counsel is directed to contact the judgment debtor forthwith and advise him/her of Local Rule 1.06 and the court’s tentative ruling procedure and the manner to request a hearing, along with the correct address for Department 53/54. If judgment creditor’s counsel is unable to contact the judgment debtor prior to hearing, judgment creditor’s counsel is ordered to appear at the hearing in person or by telephone.

This claim of exemption is on the court’s own motion CONTINUED to 3/21/2018 at 9:00 a.m. in this department to permit the judgment debtor to file and serve no later than 3/12/2018 the documentary evidence necessary to establish that the bank funds at issue are under California law exempt from levy. (Code Civ. Proc. §703.080.)

Judgment debtor is encouraged to redact any account numbers prior to filing and serving the required documentation.

Judgment creditor’s counsel to provide notice of this ruling and file proof of service of same no later than 2/28/2018.
