[TENTATIVE] order RE:
motion for leave to intervene by Safeco insurance company of America
Proposed intervenor Safeco Insurance Company of America (“Safeco”) seeks an order granting leave to intervene in the present action pursuant to CCP §387.
CCP §387 allows a person to intervene when they have an interest in the matter in litigation or in the success of either of the parties. CCP §387(b) provides that “if the person seeking intervention claims an interest relating to the property or transaction which is the subject of the action and that person is so situated that the disposition of the action may as a practical matter impair or impede that person’s ability to protect that interest, unless that person’s interest is adequately represented by existing parties, the court shall, upon timely application, permit that person to intervene.”
Safeco argues that it is a party which may be required, pursuant to the terms and conditions of its policy of insurance issued to Defendant Ruben Lopez (“Lopez”), to pay any judgment entered in favor of Plaintiff, and is therefore an interested party. Safeco has made numerous attempts to locate and communicate with Lopez without success. (Mot., at pg. 2-3.)
The Court finds that Safeco has made sufficient attempts to contact Lopez, and that it has a sufficient interest in this matter to support its intervention in this case. Therefore, Safeco’s unopposed motion to intervene is granted.
Conclusion and Order
Safeco’s motion to intervene is granted pursuant to CCP §387. Safeco has an interest in the matter in litigation. Safeco must file its Answer-In-Intervention within ten (10) days of the entry of this order.
Safeco is ordered to provide notice of this order.
