Plaintiffs’ motion for entry of judgment against Defendant Dimo LLC, dba Swimming
Pools Etc. (CCP 664.6) is DENIED without prejudice.

Plaintiffs seek to enforce judgment based on Defendant’s purported failure to comply
with the parties’ settlement agreement. In support of their motion, Plaintiffs proffer the
declaration of their counsel, Julie A. Doumit. Ms. Doumit’s declaration, however, does
not comply with CCP 2015.5 as she fails to state the place of execution or that it is “certified or declared under the laws of the State of California.”

Defendant opposes the motion on the grounds that given Ms. Doumit’s defective
declaration, the motion fails to contain any legally-recognizable evidence.
The Court agrees with Defendant. Accordingly, the motion is DENIED without
prejudice.

The minute order is effective immediately. No formal order pursuant to CRC Rule
3.1312 or further notice is required.
