Defendant, Wag Labs, Inc. propounded RPDs, set two on Plaintiff on 12/07/18. Additionally, Plaintiff propounded RFAs, set two, on Defendant, United Valet Parking, Inc. on 2/26/19. To date, despite an extension of time to respond and attempts to meet and confer, Plaintiff has not served responses to the RPDs. Defendant therefore seeks an order compelling Plaintiff to respond, without objections, to the outstanding discovery, and requiring Plaintiff and her attorney to pay sanctions.

Defendant’s motion to compel is granted. Plaintiff is ordered to serve verified responses to RPDs, set two, without objections, within ten days. CCP §2031.300(a),(b).

Sanctions are mandatory. §2031.300(c). Defendant seeks sanctions in the amount of $910. Counsel bills at the rate of $170/hour. The Court awards one hour of time to prepare this form discovery motion. No opposition was filed and therefore no reply was necessary. The Court awards the requested three hours to appear at the hearing on the motion, as Counsel is located in Long Beach. The Court therefore awards a total of four hours of attorney time at the requested rate $170/hour, or $680 in attorneys’ fees. The Court also awards the filing fee of $60. Sanctions are sought against and imposed against Plaintiff and her attorney of record, jointly and severally; they are ordered to pay sanctions to Defendant, by and through its attorney of record, in the amount of $740, within twenty days.

Moving Defendant is ordered to give notice.
