Self-represented judgment debtor Shalita S. Sellers’ motion to pay judgment in installments is UNOPPOSED and is GRANTED.
On August 9, 2012, Judgment was entered against Shalita S. Sellers in the amount of $14,472.84. Ms. Sellers now moves for a Court order that she may pay the Judgment in installments of $50 per month, payable on the 5th day of each month.
CCP ยง 582.5 provides in pertinent part that in a limited civil case, the court may amend the terms and conditions for payment of the judgment or order at any time to provide for installment payments for good cause upon motion by a party and notice to all affected parties, regardless of the nature of the underlying debt and regardless of whether the moving party appeared before entry of the judgment or order. In any determination regarding the imposition of terms and conditions upon the payment of the judgment, the court shall consider any factors that would be relevant to the determination of a claim for exemption.
Ms. Sellers has provided a declaration detailing her financial information.
The Court finds that the installment payment plan is reasonable. Ms. Sellers shall make monthly payments of $50 to judgment creditor by the 5th day of each month, commencing on January 5, 2019.
The minute order is effective immediately. No formal order pursuant to CRC Rule 3.1312 or further notice is required.
