If requested, oral argument will take place on Monday January 22, 2018 at 2:00 p.m. in Department 53. If that date is not convenient, the parties may meet and confer on a later date and inform the court clerk of the date no later than 4:00 p.m. on January 18, 2018.

Claim of exemption is denied insofar as the judgment creditor is entitled to the same 17% garnishment that is currently in place. Any amounts being retained in excess thereof are to be returned to the judgment debtor.

Based on claimant’s financial statement, her take home pay of $2667, after the 17% garnishment payroll deduction, exceeds her expenses of $1,648. Therefore, she has approximately $1,000 income beyond the necessities of life.

The employer may send one payment per month to reduce the administrative expenses of the garnishment.
