IN THE COURT OF APPEAL OF THE STATE OF CALIFORNIA

SECOND APPELLATE DISTRICT

DIVISION SIX

THE PEOPLE,

Plaintiff and Respondent,

v.

ANTHONY RENE CASTANEDA,

Defendant and Appellant.

2d Crim. No. B298645

(Super. Ct. No. 2018037895)

(Ventura County)

Anthony Rene Castaneda appeals the judgment entered following his guilty plea to residential burglary (Pen. Code, § 459). Appellant also admitted allegations that he committed the burglary while another person other than an accomplice was present in the residence (§ 667.5, subd. (c)(21)) and had suffered a prior strike and serious felony conviction (§§ 667, subds. (a)(1), (c)(1) & (e)(1), 1170.12, subds. (a)(1) & (c)(1)) and had served a prior prison term (§ 667.5, subd. (b)). The trial court sentenced him to nine years in state prison.

Because appellant pleaded guilty prior to trial, the relevant facts are derived from the transcript of the preliminary hearing. On October 21, 2018, appellant entered the garage of a residence and stole several items from the garage and from a vehicle parked inside the garage. He subsequently confessed to the crime.

We appointed counsel to represent appellant in this appeal. After counsel’s examination of the record, he filed an opening brief in which no issues were raised. On September 18, 2019, we advised appellant that he had 30 days within which to personally submit any contentions or issues he wished us to consider. No response has been received from appellant.

We have reviewed the entire record and are satisfied that appellant’s attorney has fully complied with his responsibilities and that no arguable issues exist. (People v. Wende (1979) 25 Cal.3d 436, 443; People v. Kelly (2006) 40 Cal.4th 106, 126.)

The judgment is affirmed.

NOT TO BE PUBLISHED.

PERREN, J.

We concur:

YEGAN, Acting P.J.

TANGEMAN, J.
Bruce A. Young, Judge
