PLAINTIFF’S MOTION TO COMPEL SUPPLEMENTAL RESPONSES AND PRODUCTION BY DEFENDANT IMEX, LLC, AND TO AWARD MONETARY SANCTIONS TENTATIVE RULING:
A. Request for Production of Documents, Set Three
The motion is denied as to categories 1 through 6. Plaintiff made no effort to meet and confer in good faith regarding the responses to these requests. (Code of Civ. Proc. sect. 2031.310, subd. (b)(2); see Exhibits I, J, and K. to moving Declaration of Paul.)
The motion is denied as to document categories 7 through 90. These document categories are identical to categories 1 through 84 in Plaintiff’s Request for Production of Documents, Set Two. Plaintiff offers no authority supporting the right to propound duplicate document requests.
B. Special Interrogatories, Set One.
The motion is granted. Defendant shall serve a verified supplemental response that includes the documents omitted from the original written response. The supplemental response may include, verbatim, the original written responses again, or it may simply identify the attached documents as responsive to Interrogatories 1 through 4. Defendant shall serve the verified supplemental responses no later than April 12, 2018.
C. Sanctions
Plaintiff’s motion for sanctions is denied. Defendant’s request for sanctions is granted against Plaintiff’s counsel, but not against Plaintiff. Darcy Paul and the Paul Law Group shall jointly and severally pay a monetary sanction of $1,500.00 to Defendant IMEX, LLC no later than April 19, 2018 or one week after service of written notice of this ruling, whichever date is later.
