Plaintiff’s Three (3) Motions to Compel Defendant’s Responses to Form Interrogatories, Set One; Special Interrogatories, Set One; and Request for Production of Documents, Set One; Request for Sanctions, filed on 8/7/19, are GRANTED.

Defendant, Rudolpho Perez, II, is ordered to serve verified responses to the foregoing discovery without objections within ten (10) days. Cal Code Civil Procedure § 2031.300.

Imposition of sanctions against Defendant, Rudolpho Perez, II, and his counsel, Law Offices of Peter M. Wucetich, is warranted for the failure to timely respond to authorized methods of discovery, which is discovery abuse. Cal Code Civil Procedure § 2023.010(d).

Plaintiff’s Motion to Have Requests for Admission, Set One, Deemed Admitted against Defendant, Rudolpho Perez, II; Request for Sanctions, filed on 8/7/19 is GRANTED. The Requests for Admission served on Defendant, Rudolpho Perez, II, on 9/13/18 are deemed admitted. Imposition of sanctions is mandatory where a party’s failure to respond necessitates the motion. Cal. Code Civil Procedure § 2033.280.

Accordingly, the court imposes total sanctions of $1,516.60 for all four motions against Defendant, Rudolpho Perez, II, and his counsel, Law Offices of Peter M. Wucetich. Such sanctions are payable within thirty (30) days.
