Defendant, Holly Schwartz’s Motion to Compel Plaintiff, Hripsime Shirkebyan to appear for deposition is Granted. Plaintiff is ordered to appear for deposition on Friday, April 18, 2014 at 10:00 a.m. at the State Farm Insurance Company Claims Office, located at 300 Corporate Pointe, Suite 200, Culver City, CA 90230.

Defendant’s Request for Sanctions is Granted. Plaintiff and his attorney of record, jointly and severally, are ordered to pay sanctions to Defendant, by and through counsel of record, in the amount of $497.38.

Plaintiffs, Zhora Khashkashyan and Hripsime Shirkebyan filed this action against Defendant, Holly Schwartz (erroneously sued and served as Holy Schwartz) for damages arising out of an automobile accident.

On 3/01/13, Defendant served Plaintiff, Hripsime Shirkebyan with a notice of taking deposition, setting Plaintiff’s deposition for 5/28/13. Plaintiff did not appear for deposition and, despite meet and confer efforts, the deposition has not been re-set. Defendant therefore moves to compel Plaintiff to attend his deposition at this time.

The motion to compel is granted. CCP §2025.450(a). Defendant seeks sanctions against Plaintiff and his attorney of record in the amount of $497.38. Sanctions are mandatory. §2025.450(c). The amount is fully supported by the Declaration of Counsel and is granted in full.

The Court notes that it appears, per the moving papers, that Plaintiff’s attorney has represented his intent to withdraw as counsel. To date, however, Counsel has not filed a motion to be relieved and has not filed a substitution of attorney.
