Attorney Betty Kwan was listed as the lawyer for the plaintiff in a breach of contract case.
During the lawsuit the defendant served Kwan's client with a request to answer written questions and to produce documents about the claims and issues in the lawsuit.
Eventually, motions to compel further responses had to be filed by the defendant.
The motions sought sanctions against attorney Betty Kwan personally. For example:
After the motions were filed Kwan's client substituted her out as her attorney and replaced her with another lawyer.
After reviewing the motions submitted both for and against the motions, the judge issued a tentative ruling granting the motions.
The judge said any claims of privilege or privacy rights in connection with the discovery had to be asserted in a detailed privilege log.
The judge also said attorney Betty Kwan would be sanctioned $6520.
After the hearing on the matters and oral argument of counsel, the judge adopted the tentative ruling as the final order of the court.
Attorney Betty Kwan was then sanctioned $6520.
$6520 is a huge amount of sanctions in our opinion.
Lawzilla has read hundreds of discovery sanctions orders and this is one of the largest.
It was also notable to us that after the sanctions motion against attorney Kwan was filed she was replaced as the attorney in the case.
We also noted that in the judge's order only Betty Kwan, Esq., was sanctioned.
