Mark Ewell Ellis Sanctions

NEW PEKING BUFFET INC VS DING HE CHEN - This tentative ruling says the Mark Ellis firm, representing a plaintiff, noticed the deposition of defendants' former attorney and requested communications between the attorney and his client relating to his client's discovery responses. The court said such communications are privileged and an attorney cannot be noticed for a deposition absent a high standard - but Mark Ellis not only failed to meet that high standard, Mark Ellis had failed to show any relevance for the depositon. The judge also noted Mark Ellis was previously warned about this. The court said it was going to sanction Mark Ellis a large and significant amount - $3720. Ironically, the Mark Ellis firm claims legal malpractice as a specialty.

Ellis Law Group LLC vs. Marison M Mull - This tentative ruling says the Ellis Law Group was to be sanctioned $1110 for abusing discovery and providing vague answers. The judge also criticized the firm's attorney for engaging in personal attacks of the other counsel. Note: although the court's tentative order listed the law firm as Ellis Law Group, LLC, it probably should be Ellis Law Group, LLP.

Robert Michael Wiegand vs. National Enterprise Systems, Inc. - This tentative ruling indicates Mark Ellis represents the defendant. The court reprimands Mr. Ellis for "sharp" litigation practices intended to buy-off a plaintiff to prevent a class action. The judge indicates he will not allow it. Additionally, for the discovery motion at hand where attorney Ellis' client has not answered written questions, requests for admission, and requests to product documents, the court said it was issuing sanctions of $410.

Mark Ewell Ellis was admitted to the California Bar in 1986. Bar Number 127159.
