Hamed Yazdanpanah Sanctions

Juan Carlos Escobar vs. William Rowe - Hamed Yazdanpanah is the attorney for the plaintiff according to the ruling from the court.

From the tentative ruling this is what happened:

Attorney Hamed Yazdanpanah represents the plaintiff in this case.

The defendant served discovery on Yazdanpanah's client consisting of written questions to answer, requests to produce documents, and requests for admissions.

This was in September 2017.

The judge begins his ruling by noting there was a prior court order in January 2018 - apparently imposing sanctions for discovery abuse on Hamed Yazdanpanah's client.

Note: This means we are looking at at least two sanctions orders involving Yazdanpanah's client just in this one lawsuit.

The court then notes that as of February 2018, attorney Yazdanpanah had still not served a verification to responses for the September 2017 discovery.

Responses without a verification can be useless and are considered tantamount to not responding to the discovery at all.

Note: What we believe is happening is attorney Yazdanpanah sent defendant claimed responses to discovey for his client, but no verification from his client that they were true. It is thus unknown if Yazdanpanah did the responses on his own or if his client agreed they were accurate. How can an attorney prepare responses and serve them claiming to be from his client, without getting his client's signature to the responses verifying they are accurate?

The ruling indicates Yazdanpanah did not bother to oppose motions to compel and their request for sanctions.

The judge then made the following tentative order against Hamed Yazdanpanah and plaintiff.

First, the judge tentatively said responses to the written questions and document requests needed to be made within thirty days.

Second, the judge said all the requests for admissions were tentatively admitted as true.

Note: This second part of the order is probably more important than anything else, including monetary penalties. We have not seen the admissions, but typically an order like this ends the case. If the discovery is halfway decent Yazdanpanah's client is admitting facts that could destroy his case.

Third, the judge tentatively ordered attorney Hamed Yazdanpanah to pay $617.50 in sanctions.

Update: A later review of court documents indicates a hearing was held and attorney Yazdanpanah appeared. The parties stipulated the motion pertaining to the requests for admission was moot. As a result the judge did not order that any of the requests be deemed admitted. The judge also reduced the sanctions against the attorney and his client to $530.



FRANCISCO ARMENTA VS MIKIRO AMEMIYA - Hamed Yazdanpanah is the attorney for the plaintiffs according to the ruling from the court, and per the filed complaint.

From the tentative ruling this is what happened:

Attorney Hamed Yazdanpanah represents the plaintiffs in this case.

The defendants scheduled the depositions of Yazdanpanah's clients in December 2017. The depositions did not happen.

Defendants scheduled new depositions for January. The day before the depositions were to take place attorney Yazdanpanah said they were not going forward and no new dates were suggested. Plaintiffs did not appear for their depositions.

The judge then ordered the depositions to occur within fifteen days.

Then the judge personally sanctioned attorney Hamed Yazdanpanah for misuse of the discovery processs and acting without substantial justification.

Hamed Yazdanpanah was ordered to pay $680 in sanctions. The amount was payable within thirty days.

Update: A later review of court documents indicates a hearing was held but attorney Hamed Yazdanpanah did not bother to appear. The judge then confirmed the tentative ruling as the final order of the court.



VICTOR GREEN VS MANNY GUTIERREZ - Hamed Yazdanpanah is the attorney for the plaintiffs according to the ruling from the court, and per the Los Angeles online case summary.

From the tentative ruling this is what happened:

Attorney Hamed Yazdanpanah represents the plaintiffs in this case.

Defendants served discovery consisting of requests that certain facts be admitted as true and for answers to written questions.

When responses to the discovery were not received a letter was sent to Mr. Yazdanpanah requesting a response. After receiving nothing motions to compel were filed.

In the case docket we do not see that Hamed Yazdanpanah opposed any of the motions to compel.

The result was the judge made the following tentative orders:

1. Attorney Yazdanpanah's clients were to be ordered to answer the questions within twenty days.

2. All the facts in the requests for admissions were to be deemed admitted as true. As noted in the other case, having facts be admitted against his clients are probably devastating to their case. This can be tantamount to losing the lawsuit.

3. Hamed Yazdanpanah was to be personally sanctioned $540. His client was to be sanctioned too.

Update: A later review of court documents indicates a hearing was called by the judge but no one appeared and no one explained to the judge why no one was there. The defendants' motions were then taken off calendar. A day later Mr. Yazdanpanah filed a notice the case had settled. The result is no sanctions were ordered.


Questions and Answers

Would you hire Hamed Yazdanpanah to be your attorney?

In our opinion what the judge says about the attorney is bad in the first sanctions order. Then failing to provide a client verification with discovery responses. Then not opposing motions to compel. However, to his credit Yazdanpanah did appear for the hearing, was able to moot one of the motions, and had the sanctions reduced.

Then there is the issue of repeated sanctions and what judges are saying about the attorney.

Do you think the Los Angeles judges consider Yazdanpanah to be a competent attorney? Why would anyone hire an attorney with a poor reputation who is repeatedly getting sanctioned?

If you are keeping score we have found more than $1800 in proposed sanctions against attorney Hamed Yazdanpanah that judges said they were going to impose. The final amount of sanctions was $1210 because one case settled so that a final sanctions order could not be made, and in another case the proposed sanctions were reduced in the final order.
