This is a car accident case.

Attorney Jared Slater represents the defendant. He served discovery for plaintiff to respond to, including a request for documents and written questions to answer.

Normally a party has thirty days to provide responses and an attorney has the same amount of time to make objections, or else the objections are waived. No responses or objections were forthcoming from plaintiff or his counsel.

Jared Slater's office sent a meet and confer letter about the situation. Still there was no response. Attorney Slater then filed a motion to compel.

Plaintiff did not file an opposition to the motion.

The judge ordered plaintiff to provide full responses to the discovery, without objection, within twenty days.

The court then awarded $390 in sanctions attorney Jared Slater's client, to be paid within twenty days.

The court's minute order from the hearing says plaintiff and his attorney did not appear. The judge's tentative ruling was adopted as the court's final order.



Lawzilla Commentary:

The defense attorney has the option of requesting sanctions against just the plaintiff, just the attorney, or both, depending on who is at fault. The judge, though, has the final say on who is sanctioned. Here, attorney Jared Slater believed both the plaintiff and his attorney were at fault, and the judge agreed.

It is our belief that since no responses to the discovery were made a motion to compel could have immediately been filed. We thought it was professional and courteous for Jared Slater to first send a meet and confer letter, and only after that was not responded to was a motion filed.
