Judge Sanctions Jeffrey Lipow $10,500

Loses and Other Party Seeks $22,910.84 for Costs

Rassoli v Tag Enterprises Los Angeles County Superior Court Case Number BC694539.

From the Los Angeles court online case records it is Lawzilla's understanding the following occurred:

Attorney Jeffrey Lipow represented the plaintiffs in a business discrimination and interference with contract case.

Mr. Lipow is also listed in court's case summary as the attorney of record for plaintiffs.

During the lawsuit various discovery related motions were filed. Included were motions for a protective order and to compel a deposition.

According to Lawzilla's understanding of the court record, the judge sanctioned attorney Jeffrey Lipow a total of $7500 in connection with these matters.

Apparently, the sanction was not immediately paid because the court file has a writ of execution where defense counsel apparently obtained a directive for the sheriff to enforce a $7500 judgment against attorney Jeffrey Lipow.

The defendant also requested that one of Lipow's clients produce documents - they ultimately filed a motion to compel.

The judge ruled objections to the requests made by Jeffrey Lipow's office were overruled. The judge also said a representation of partially responsive documents was insufficient.

The court then awarded $3000 in sanctions against both plaintiff and his counsel of record, to be paid within 5 days.

That would make total sanctions of $10,500.

Ultimately, after various other orders were made by the trial judge, it appears to Lawzilla that Jeffrow Lipow's clients sought to agree to a consent judgment in favor of a defendant, possibly to expedite an appeal of the other orders.

The court file indicates the defendant sought $22,910.84 in costs against Mr. Lipow's client, although the final amount awarded by the court was not indicated at the time Lawzilla reviewed the file.

Lawzilla Opinion and Review

Lawzilla found a California State Bar order, involving a different attorney, indicating that being sanctioned by a judge for discovery abuse can result in State Bar discipline for failing to competently perform legal services.

It appears to us $10,500 in sanctions were awarded involving attorney Lipow. It is a large amount.

From our limited review of some of the court file, our opinion was Lipow and Harris were overpowered in the case.

But this is just one case and may not reflect Jeffrey Lipow's legal abilities in other matters or against other counsel.

Still, if you were looking for an attorney we would probably suggest the opposing counsel in this matter.

There are not many attorneys savvy enough to seek a writ of execution for a sanctions order.

Apparently, Jeffrey Lipow did not ask for an accommodation from the judge to prevent the sanctions order from being enforced as a judgment, and defense counsel took advantage.
