Judge Sanctions Jonathan Kashani $768.15

Misuse of Discovery Process

Failed to Schedule Client's Deposition, Not Respond to Defense Counsel, Not Oppose Sanctions Motion, Not Appear at Court Hearing

Robles v Barajas, Los Angeles County Superior Court Case Number BC721468.

From the Los Angeles court online case records it is Lawzilla's understanding the following occurred:

Attorney Jonathan Kashani is the attorney for the plaintiff in a car accident case.

During the lawsuit the defendant noticed the deposition of Kashani's client.

Jonathan Kashani, Esq., said his client was not available that day, but did not provide any alternative dates.

Defendant re-noticed the deposition a few more times.

Ultimately, Mr. Kashani's client did not appear for a deposition.

The other attorney sent a letter to Kashani about the situation, but Kashani did not respond.

Defendant then filed a motion to compel and sought sanctions.

Attorney Jonathan Kashani did not file any opposition to the motion.

The judge said the motion would be granted and ordered plaintiff to attend a deposition.

The judge also said there was a misuse of the discovery process and sanctioned Jonathan Kashani $768.15 as well as his client.

At the hearing for the motion the court's record says attorney Kashani did not appear.

Lawzilla Opinion and Review

Would you hire Jonathan Kashani as an attorney?

Based on what the judge said happened in this case - why?

In our opinion the judge's comments reflect bad lawyering.

He was not proactive to get his client's deposition done. No excuse is mentioned in the judge's order.

He failed to communicate with defense counsel. What did he think would happen as a result?

He failed to oppose the sanctions motion against him.

He did not appear at the court hearing.

There are many great attorneys in California. We suggest finding one.

Lawzilla found a California State Bar order, involving a different attorney, that being sanctioned can itself cause State Bar discipline for failing to competently perform legal services.
