In this tentative ruling the judge says the defendant sent attorney O'Sullivan's client questions to answer and a request for documents. Normally, responses are due within thirty days. After numerous extensions it had been about five months without a response, and in the sixth month defendant finally moved to compel a response.

Michael O'Sullivan did not file an opposition to the motions.

As a result, Mr. O'Sullivan's client was being sanctioned $885 by the court.

From that ruling we do not know why Mr. O'Sullivan's office was not responding to the discovery after such a long period of time, or why he did not respond to the motion and let his client be sanctioned.

The judge does not refer to any mitigating circumstances explaining or excusing the conduct.
