From the Los Angeles court online case records it is Lawzilla's understanding the following occurred:

Attorney Paul Bojic represented the plaintiff in a breach of contract case.




During the lawsuit the defendants served Bojic's client with requests to answer written questions about the claims.

Defendants then filed four discovery motions seeking further answers to the questions and sanctions.

About four months after the motions were filed, the judge said attorney Bojic represented in a declaration that his client had provided supplemental responses to the discovery.

As a result the judge said the motions to compel were moot.

However, as to the sanctions request resulting from the filing of the motions the judge agreed in a tentative ruling sanctions were appropriate, and that $3840 in sanctions would be imposed against attorney Paul Bojic and his client.




At the court hearing on defendants' motions Paul Bojic, Esq., appeared to argue.

After considering the parties written arguments and oral argument of counsel, the judge said the tentative ruling would be adopted as the court's final order.

$3840 in sanctions were imposed.







Lawzilla Opinion and Review


In our opinion $3840 is a significant amount of sanctions.

It is much higher than the typical amount of sanctions we see in lawsuits.

There is not much information in the court's order about what happened to cause the motions to compel to be filed and for sanctions to be imposed.

We did note that even after the motions were filed it took Bojic's office about four months to get the discovery responses to the other party.

At the time this article was prepared we noticed the court docket has another sanctions motion pending against Paul Bojic and his client.

Interestingly, this motion refers to "false verified responses" - which suggests to us a potentially significant, possibly ethical issue, may be in play that could result in substantial sanctions against whoever loses that motion.

We do not recall seeing a motion in a court case alleging "false verified responses" - yet that is alleged with sanctions being sought against Paul Bojic and his client.

This is just one case, but we are concerned about the significant amount of sanctions that have already been awarded and the additional sanctions motion alleging "false verified responses" were provided in a lawsuit.
