From the court of appeals opinion it is Lawzilla's understanding the following occurred:
Attorney Robyn McKibbin from the Stone Dean law firm represented two of the defendants in a lawsuit.
Ms. McKibbin is also listed as an attorney for the appeal.
During the lawsuit one defendant retained a new attorney and filed a motion to disqualify Robyn McKibbin and her firm.
The court of appeals opinion said one of the defendants allegedly forged a signature on a document.
This was declared to have been told to attorney McKibbin.
In response to the disqualification motion McKibbin's client did not deny that he had introduced an allegedly forged document into litigation.
It was also not denied that attorney Robyn McKibbin possessed confidential information relating to the parties.
Ms. McKibbin did declare that she was not told any document was forged.
The trial court granted the motion to disqualify Robyn McKibbin, Esq., and her law firm from the case.
An appeal was filed.
However, McKibbin did not provide the court of appeals with a transcript of what was said during the hearing on the motion and what the judge considered.
The court of appeals ruled because McKibbin had not provided an adequate record she lost the appeal.
Seems like legal malpractice to us in not providing an adequate record for the appeal.
Overall, this also seems like a terrible look for an attorney.
- Not denying a forged document was submitted in a lawsuit.
- Not denying having confidential information belonging to opposing parties.
- Getting kicked out of a lawsuit by being disqualified to represent her clients.
- Losing an appeal by not providing an adequate record.
