Sergei Gladkov is plaintiff's attorney.





The defendant served discovery on Mr. Gladkov's client. This discovery consisted of written questions to answer, requests to produce documents, and requests for facts to be admitted.

However, despite attempts to meet and confer responses to all the discovery were not provided by plaintiff. Defendant then filed a motion to compel.





Attorney Sergei Gladkov, Esq., did not file an opposition to the motion to compel. He also failed to appear at the court hearing for the motion.





The judge ordered plaintiff to answer the discovery.





The judge also ordered attorney Sergei Gladkov and his client to pay $1320 in sanctions within twenty days.





The full order from the judge explaining the sanctions and reasons noted sanctions were mandatory and no opposition was filed.







Mr. Gladkov's client then did not comply with the court order. Defendant then filed another sanctions motion requesting termination of the lawsuit.





Again, Sergei Gladkov did not file an opposition to the motion.

After reviewing the situation, as an ultimate sanction the judge dismissed the lawsuit.





Defendant then filed a request to recover $1118 in costs against plaintiff.





Mims vs. Zheng The Los Angeles court records show attorney Sergei Gladkov is plaintiffs attorney in a motor vehicle accident case.




Defendant served discovery on Gladkov's clients consisting of requests to produce documents, to answer written questions, and to admit certain facts as true. No response was provided by attorney Gladkov's office to the discovery. Defendant then filed three motions to compel. The judge said Mr. Gladkov did not oppose any of the motions and the motions would be granted.




Turning to the question of sanctions, the judge said there was an abuse of the discovery process being committed. The judge said $2970 in sanctions were warranted against Sergei Gladkov and his clients.




At the court hearing for the motions attorney Sergei Gladkov did not attend to argue for himself, or his clients.





Questions and Answers

Would you hire Sergei Gladkov to be your attorney?

For his benefit assume he has a major client problem with the client refusing to answer discovery. Then why remain the attorney in the case? Why not oppose a sanctions request where the defendant is seeking monetary sanctions against the attorney? Why let the lawsuit be dismissed as a sanction?

From what we can see from the court, Gladkov did nothing to avoid the wrath of the judge. Perhaps exacerbating it by remaining the attorney and thus being responsible for the litigation strategy.

That all assumes there is a client problem, and still it is difficult to find anything positive in Gladkov's representation in this matter.

According to the judge and court file, Mr. Gladkov:

- Did not obtain his client's answers to all the discovery.

- Did not oppose a motion to compel discovery - including a request for sanctions against the attorney.

- Did not oppose a motion to dismiss the lawsuit.

- Did not appear at a court hearing.


Then we get to the second case and virtually an identical situation happened.

This could be a pattern for attorney Gladkov. An expensive pattern.


Lawzilla found a California State Bar order, involving a different attorney, indicating that being sanctioned by a judge for discovery abuse can result in State Bar discipline for failing to competently perform legal services.
