On calendar today are a total of nine motions to compel. Defendant, Antonio Saucedo Espinoza moves to compel Plaintiff, Gladys Esperanza Cruz to respond to form interrogatories, and moves to compel Plaintiff, David Cruz to respond to form interrogatories and RPDs. Defendant, Rose Angel Candia moves to compel Plaintiffs, Gladys Esperanza Cruz and David Cruz to respond to form interrogatories, special interrogatories, and RPDs.
Espinoza establishes that he propounded the subject discovery on 12/14/17. He sent a meet and confer letter on 2/23/18. Plaintiffs have not responded.
Candia establishes that she propounded the subject discovery on 10/18/17. She sent two meet and confer letters, but Plaintiffs have not responded.
All of the motions to compel are granted. Plaintiffs are ordered to serve verified responses to all of the above-detailed discovery, without objections, within ten days. CCP §§2030.290(a),(b), 2031.300(a),(b).
Sanctions are mandatory. §§2030.290(c), 2031.300(c). Espinoza seeks imposition of sanctions in the amount of $435/motion – 2.5 hours to prepare each motion and .5 hours to appear at the hearing, all at $125/hour, plus a $60 filing fee. The Court awards one hour to prepare each form discovery motion. The Court awards the requested .5 hours to appear, but only awards the time once. The Court therefore awards a total of 3.5 hours of attorney time at the rate of $125/hour, or $437.50 in attorneys’ fees. The Court also awards three filing fees of $60 each, or $180 in costs. Sanctions are sought and imposed against Plaintiffs, Gladyz and David Cruz, jointly and severally; they are ordered to pay sanctions to Defendant, by and through his attorney of record, in the total amount of $617.50, within twenty days.
Candia seeks imposition of sanctions in the amount of $860/motion – two hours to prepare each motion, one hour to review opposition and reply, and one hour to appear at the hearing, all at $200/hour, plus filing fees. The Court awards one hour to prepare each form discovery motion. No opposition was filed and therefore no reply was necessary. The Court awards one hour to appear, but only awards the time once. The Court therefore awards a total of seven hours of attorney time at the rate of $200/hour, or $1400. The Court also awards six filing fees of $60 each, or $360 in costs. Sanctions are sought and imposed against Plaintiffs and their attorney or record, jointly and severally; they are ordered to pay sanctions to Defendant, by and through her attorney of record, in the total amount of $1760, within twenty days.
