MOTION TO COMPEL DEPOSITION AND FOR SANCTIONS BY JOSEPH MIZRACHI AND JAL GROUP, L.P. TENTATIVE RULING:

Plaintiffs’ Motion to Compel Deposition is GRANTED. Defendant SEYMOUR HOLTZMAN is ordered to appear for deposition no later than November 16, 2018 and must produce documents responsive to Plaintiffs’ Notice of Deposition and Request for Production no later than November 16, 2018. The location for the deposition shall be New York City, New York.

Plaintiffs’ request for monetary sanctions against Defendant and his counsel is GRANTED in the amount of $5,110.00, to be paid no later than November 16, 2018.

If the tentative ruling is uncontested, it shall become the order of the Court, pursuant to Rule 3.1308(a)(1), adopted by Local Rule 3.10, effective immediately, and no formal order pursuant to Rule 3.1312 or any other notice is required as the tentative ruling affords sufficient notice to the parties.

MOTION TO COMPEL RESPONSES TO DISCOVERY AND FOR SANCTIONS BY JOSEPH MIZRACHI AND JAL GROUP, L.P. TENTATIVE RULING:

Plaintiffs JOSEPH MIZRACHI and JAL GROUP, L.P.’s Motion to Compel Further Discovery Responses is GRANTED in part. Defendant SEYMOUR HOLTZMAN is ordered to serve full and complete, verified, Code-compliant responses to the following discovery no later than November 9, 2018:

 Form Interrogatories Nos. 2.1, 2.2, 2.4, 2.6, 2.11, 3.1, 3.2, 3.3, 3.4, 3.5, 3.6, 3.7, 17.1 and 50.1;  Special Interrogatories Nos. 13, 14, 15, 16 and 17;  Requests for Production Nos. 3, 4, 5, 6, 7, 8, 9, 10, 13, 14, 16, 17 and 19; and  Requests for Admission Nos. 1, 5, 10, 11, 12, 16, 17, 24, 25, 26, 28, 29, 32, 36, 37, 38, 39, 40, 41, 42 and 43.

Plaintiffs’ request for monetary sanctions against Defendant and his counsel is GRANTED in the amount of $3,660.00, to be paid no later than November 9, 2018.
