SUPERIOR COURT OF CALIFORNIA
COUNTY OF LOS ANGELES, STANLEY MOSK COURTHOUSE
DEPARTMENT 93

MARINA ESTRADA BAEZ,

Plaintiff(s),

v.

CHAHN PHAN, et al.,

Defendant(s).

Case No.: BC502423

Hearing Date: February 9, 2015

[TENTATIVE] ORDER RE:
MOTION OF COUNSEL, ERICK B. NOVIK, TO BE RELIEVED AS COUNSEL

The Motion of counsel, ERICK B. NOVIK, TO BE RELIEVED AS COUNSEL is GRANTED.

BACKGROUND

This case arises out of a motor vehicle accident that occurred on October 27, 2011. On March 7, 2013, Marina Estrada Baez (“Plaintiff”) filed a complaint asserting causes of action for Motor Vehicle and General Negligence against Chanh Phan and EAN Holdings, LLC (collectively “Defendants”). Plaintiff hired Erick B. Novik (“Counsel”) to represent her in the case against Defendants. This motion to be relieved as counsel was served on all parties on January 8, 2015, and filed on January 9, 2015. No opposition has been filed.

DISCUSSION

Counsel asserts considerable differences of opinion regarding the handling of this action have arisen between Plaintiff and Counsel. Based on these differences, Counsel asserts he believes he can no longer effectively represent Plaintiff in this action. Counsel states he is unable to provide additional details due to the attorney-client privilege.

Additionally, Counsel has submitted Civil Forms MC-051, MC-052, and MC-053. Counsel has also filed proof of service of the same on all parties. Furthermore, trial is not scheduled until April 20, 2015, and therefore granting this motion will not prejudice Plaintiff. Accordingly, this motion is GRANTED.

ERICK B. NOVIK is ordered to give notice of this ruling.

Dated: February 9, 2015
