[TENTATIVE] ORDER GRANTING PLAINTIFF’S MOTION TO TRANSFER VENUE

Plaintiff, Emily Kupinsky filed this action against Defendant, The Vons Companies, Inc. for damages arising out of a slip and fall. Plaintiff moves to transfer venue, contending venue is only proper in Ventura County because the incident occurred in Ventura County.

Defendant and Plaintiff have agreed to the venue transfer, and Plaintiff’s attorney declares the request for a transfer was initiated by Defense Counsel. The motion to transfer venue is granted.

CCP §399(a) obligates the plaintiff to pay the fees if the motion is granted on the “wrong court” ground. The motion provides for a venue transfer because Los Angeles is the “wrong court” to hear the case. Plaintiff is therefore ordered to pay the transfer fees.

Plaintiff is ordered to give notice.
